Violating the Constitution to Protect the Constitution?

You know, for someone who is so concerned about strict interpretation of the Constitution, the Bush administration has sure been getting pretty creative in their own interpretation of it lately. First, this idea that "the consent of the Senate" means a simple 51 vote majority, Senate rules be damned, when the Constitution specifically states that the Senate and House shall set their own rules. Now, this abuse of the recess appointment to fill vacancies to key posts that occured BEFORE the Senate went on recess, where the delay until recess was caused by the President himself. In fact, he waited only ONE DAY, clearly violating the intention of our Founding Fathers!

Article II. Section 2.


Clause 2: He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

Clause 3: The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

What a joke. "Reality is overrated" indeed.
